DISCLAIMER

ATTENTION ALL CUSTOMERS

 

Washburn's has several disclaimers regarding our products, production, shipping and handling. We try to be as open and upfront with our customers as possible. There are certain things that are out of our control such as; when adapters leave our warehouse we are no longer responsible for that freight. By placing an order with Washburn Company you are agreeing to the terms below. These are provided to ensure that both parties are aware of and agree upon this arrangement to mutually protect and set expectations on our service.

PRODUCTS

  • BUMP STOPS- MOST of our items that offer bump stops have it under the listing. This information is not to be hidden or misguided but, another outlet for us to notify our customer of potential issues.
  • If your adapter has bump stops you must notify us BEFORE the adapter is built.
  • If we are not notified before shipment, the repairs will fall onto the customer.
  • If the item is shipped and we have not been notified of bump stops. The product will NOT fit, adjustments will need to be made and Washburn's will assume NO responsibility for this.
  • Bump stops can be shaved off if the tilt is not needed; that is under the discretion of the customer.
  • Any modifications done to an adapter NOT approved by Washburn Company will NOT be covered by us.
  • All modifications, repairs and adjustments must be approved PRIOR to work and will need to be signed off on or will be denied.
  • Warranty is NULL & VOID when a product is modified in ANYWAY.

SHIPPING

  • FedEx LTL operates completely as it's own entity and is NOT associated with Washburn's in any way. They impose their own regulations and rules outside of our control. ANY fee's that are incurred during shipping will be put onto the customer directly.
  • Lift gate fee's are for residence who have no way to unload the truck. This will be an additional $75.00 +
  • FedEx allows 15 minutes, after that the customer will incur a $30 waiting fee.

 

DELIVERY DATES

  • You agree that any delivery dates or lead times provided by us are estimates only. We cannot guarantee shipping or delivery times, which may vary significantly based on the products you are ordering, location and product availability. Other factors include: Our shipping company not picking up due to weather or time restraints, lost items in transit labor shortages or supply chain shortages.

FAILURE TO ACCEPT PRODUCTS ON DELIVERY

  • If you reject delivery of goods ordered from us, or otherwise fail to accept delivery of the goods, you agree to pay for all related and additional shipping fees, duties, taxes and other charges arising from such failure to accept. After such failure to accept delivery of the goods it shall be your responsibility to pay for and arrange a new shipping date.
  • If our shipping carrier tries to deliver more than 3x the freight will be returned and the customer is therefor responsible for all freight charges incurred and all future charges to receive the package.

RETURNS

  • Washburn Company offers returns and exchanges in limited circumstances as follows:
  • In order to submit a return you must call us at 800-283-7107 or email us at: info@hayspear.com for us to confirm the items return are eligible.
  • To be eligible for a return you must commence the return process within 30 days of receiving your item.
  • The item must be unused. Once the item has been hooked up, welded on or any other signs of use the item can be declined upon receiving and the customer will then incur additional charges.
  • No item can be returned after 30 days, no exceptions.
  • For items that are under warranty; please see our warranty tab for all questions.
  • Washburn company has the right to add a 20% stocking fee on any order that is not a typical build. This will be known to the customer before the return is initiated.
  • Shipping costs are never refundable. We deny the right to accept any shipping charges otherwise incurred by the customer.

LOST OR DAMAGED

  • If the item is damaged when you receive it, you must notify us with 48 hours or receipt. If the item is visibly delivered damaged the customer MUST notify the driver, the driver will make note and the package can then be denied.
  • If the driver is not noted, the lost or damaged item may be declined for refund or replacement.
  • Washburn's will take responsibility for lost and damaged items. A replacement will be sent out once a claim has been initiated.

WARRANTY

  • We offer a 1 year warranty on our bale spears.
  • No warranty on powder coat, as is.
  • We offer our customer a color option; however if the item is shipped in the wrong color but proper fit, no refund will be issued.
  • Washburn's offers a 1 year warranty on all welds ONLY.
  • If there is a break in a weld, we will offer compensation or replacement within our discretion.
  • We specialize in custom fabrication jobs; we are aware of misused items and adapters.
  • If a product has been misused, we have the right to deny the warranty coverage and the customer will assume all responsibility for damaged item.
  • ANY product that has been modified, cut on, welded to or in any way altered, warranty is VOID AND NULL immideitely.
  • NO compensation will be made to a customer if work is done without our prior approval; even if the product arrives malfunctioning.
  • Any item that needs modifications must be done so by Washburn Company OR approved prior to work
  • Washburn Company will deem what is and isn't necessary modifications.
